Terms of Service

Arise – Habit Tracker

Please read these Terms of Service ("Terms") carefully before downloading or using Arise – Habit Tracker ("Arise", "the app", "we", "our"). By downloading or using the app, you agree to be bound by these Terms.

1 — Acceptance of Terms

By downloading, installing, or using Arise on your iPhone, you confirm that you are at least 13 years old, that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree, do not use the app.

2 — The App and Licence

Arise is an iOS habit tracking application developed and distributed independently via the Apple App Store.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use Arise on any iPhone you own or control, solely for your own personal, non-commercial purposes.

You may not:

  • Copy, modify, or distribute the app or any part of it
  • Reverse engineer, decompile, or disassemble the app
  • Use the app for any unlawful or unauthorised purpose
  • Remove or obscure any copyright or proprietary notices
  • Attempt to gain unauthorised access to any part of the app's systems

3 — Free Plan and Pro Subscription

Arise is free to download and use with the Free plan. The Free plan includes a limited set of features at no cost, with no time restriction. No credit card is required to use the Free plan.

Arise Pro is an optional paid subscription that unlocks additional features. All Pro subscriptions are processed through the Apple App Store using Apple's in-app purchase system (StoreKit 2).

Billing

  • Pro is available as a monthly or annual auto-renewable subscription
  • Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date
  • Payment is charged to your Apple ID at confirmation of purchase
  • Pricing is displayed in the app before purchase and may vary by region based on App Store pricing

Cancellation and Refunds

  • You may cancel your subscription at any time via Settings → [Your Name] → Subscriptions on your iPhone
  • Cancelling stops future renewals; you retain Pro access until the end of the current paid period
  • Refunds are governed entirely by Apple's refund policy. To request a refund, visit reportaproblem.apple.com
  • We do not process refunds directly

Downgrade

If your Pro subscription expires or is cancelled, your account returns to the Free plan. Your first 5 habits (by creation date) remain active. Any habits beyond that limit are paused — not deleted — and will be reactivated if you re-subscribe to Pro. All your habit history and data are preserved.

4 — Your Data

All habit data you create in Arise is stored on your device and, optionally, in your personal Apple iCloud account. We have no access to your data.

You are solely responsible for the content of your habits, notes, and any data you enter into the app. You retain full ownership of all data you create in Arise.

5 — Intellectual Property

Arise, its name, logo, design, and all original content within the app are the intellectual property of the developer. All rights are reserved.

Your use of the app does not grant you any ownership of or rights to the app itself, its code, its interface, or its brand.

6 — Availability and Updates

We aim to keep Arise available and up to date, but we do not guarantee that the app will be available at all times or on all devices.

We may:

  • Update the app to add, change, or remove features
  • Modify the Free plan's included features with reasonable advance notice
  • Discontinue the app, in which case we will provide notice where reasonably possible and cease charging subscriptions

Where a change to the Free plan's features would materially reduce functionality you currently rely on, we will provide at least 30 days' notice within the app.

7 — Third-Party Services

Arise integrates with the following Apple services:

We do not integrate with any other third-party services, analytics platforms, or advertising networks.

8 — Disclaimer of Warranties

Arise is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

  • The app will be error-free or uninterrupted
  • Any defects will be corrected
  • The app will meet your specific requirements

Use of the app is at your own risk.

9 — Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use Arise, including but not limited to loss of data, loss of streaks, or any other intangible losses.

To the maximum extent permitted by applicable law, our total liability to you for any claim arising from these Terms or your use of the app is zero. Arise is provided free of charge and without any guarantee of fitness for a particular purpose.

Nothing in these Terms excludes or limits liability that cannot be excluded by applicable law, including liability for death or personal injury caused by negligence, or for fraud.

10 — Governing Law

These Terms are governed by the laws of the Kingdom of Cambodia, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Cambodia.

If you are a consumer in the European Union, you may also have rights under your local consumer protection laws that these Terms cannot override.

11 — Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page and display a notice within the app on next launch.

Continued use of Arise after the updated Terms take effect constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you should stop using the app and cancel any active subscription.
